Ford Fusion Giveaway Official Rules

Country Music Foundation, Inc. (“CMF”) is a Tennessee nonprofit corporation, among the purposes of which is to collect and preserve for the public art, literature, music and memorabilia related to country music.  CMF has been declared to be a tax-exempt organization under Section 501(c)(3) of the United States Internal Revenue Code.  CMF is conducting this Giveaway (the “Giveaway”), as part of its fundraising and public relations efforts.

    1.    The Giveaway.  CMF is giving away a 2010 Ford Fusion Hybrid automobile, (the “Grand Prize”).*  All persons purchasing a membership to the Country Music Hall of Fame® and Museum or renewing an existing membership between October 12, 2009 and November 29, 2009 will be automatically entered to win.  A new or renewed membership at the General Membership level will entitle the new/renewing member to one (1) entry; new or renewing memberships at the Friends or Circle Society levels will entitle the new/renewing member to one entry for each Twenty-Five Dollars ($25) paid.  For example, a new/renewing member at the $250 Friend level will receive ten (10) entries.  Individuals may also enter the Giveaway [a] by registering online at www.CountryMusicHallofFame.org; [b] in person at the Country Music Hall of Fame® and Museum; or [c] by legibly writing or typing their name, mailing address, telephone number, including area code, and e-mail address (if any) on a postcard (or on a sheet of paper placed in an envelope) and mailing it, postage paid, to: All for the Hall, Ford Fusion Giveaway, 222 Fifth Avenue South, Nashville, TN 37203.  Only one (1) alternative method registration/entry per person is permitted.  Each entry represents one chance to win.  All new/renewing memberships and alternative method entries must be received by CMF, physically or online, on or before 11:59 p.m., Central Time, on November 29, 2009.  The winning entry will be selected by a random drawing held by CMF and each entry has an equal opportunity to win.

    2.    Eligibility.  The Giveaway is open to new and renewing members and individuals entering by alternative methods (only individuals may enter by alternative methods) who [a] are legal residents, for purposes of all applicable state and federal tax laws, in one of the fifty (50) United States or the District of Columbia (excluding Guam, Puerto Rico, and all other U.S. and foreign territories and possessions) ("Eligibility Area"), [b] are 18 years of age or older at the time of entry, and [c] have the ability to enter into valid contracts in their personal jurisdiction of residence.  The Giveaway is VOID outside of the Eligibility Area and where otherwise taxed, prohibited or restricted by law.  Employees, and trustees and officers of the board of directors of CMF and their immediate families or others living in the same household with any such person are not eligible to enter or win.  Persons providing (or employed by any entity providing) prizes, facilities, locations, advertising or media services, printing services, telephone services, and any records, devices or other supplies to conduct the Giveaway; nor any officer, employee, agent or subcontractor of any such person; nor any member of the immediate family or living in the same household of any such person are not eligible to enter or win.  As used herein, “immediate family” is defined as (x) the spouse, parents, grandparents, great-grandparents, brothers, sisters, children, grandchildren, and great-grandchildren of a person and his/her spouse and (y) individuals for whom such person is the current legal guardian or individuals who are not legally related to but who reside with such person (e.g., “step” relationships).  Entry into the Giveaway constitutes and is deemed an agreement to be bound by these Official Rules and that any and all decisions of CMF and any third-party judges are final and binding in all respects.

    3.    Determining the Winner.  On or about November 30, 2009, one hundred (100) qualifying entries will be selected at random by or on behalf of CMF (“Qualifying Entries”).  No single individual or entity shall be entitled to more than one (1) Qualifying Entry.  Upon confirmation of eligibility, the holders of the Qualifying Entries will be invited to the final drawing to be held live at the Country Music Hall of Fame® and Museum on December 6, 2009 (“Final Drawing Event”).  Each holder of a Qualifying Entry who is physically present (or represented by an agent, who has been duly authorized in writing) in person at the Final Drawing Event at the time specified by CMF shall receive one (1) entry for the final drawing (a “Final Drawing Entry”).  CMF shall select one (1) Final Drawing Entry at random at the Final Drawing Event to receive the Grand Prize.  The identification of the winner will be available no later than five (5) business days following the Final Drawing Event at www.CountryMusicHallofFame.org.  Such information may also be obtained by sending a written request, along with a stamped, self-addressed envelope, for receipt no later than fourteen (14) business days following the Final Drawing Event, to: Country Music Foundation, Inc., Winner Request, 222 5th Avenue South, Nashville, Tennessee 37203.

    4.    Awarding of Grand Prize.  Upon confirmation of eligibility and execution of requested eligibility and release documents, the holder of the winning Final Drawing Entry will be awarded the Grand Prize.  In the event that the winning entry is from a new or renewing Family Membership or any membership held in the name of a legal entity or family, the person responsible for submitting the new/renewing membership will be awarded the Grand Prize, unless otherwise determined by an entity member.  The winner will be responsible for any and all federal, state, and local taxes incurred in winning and accepting the Grand Prize, required title and/or vehicle registration and transfer fees and all other expenses incurred in winning, accepting and redeeming the Grand Prize.  Dollar amounts are expressed in U.S. currency.  The winner will receive an IRS 1099 form reporting the value of the Grand Prize*.  Any stated values of prizes represent CMF’s good-faith determination of the retail value of the prize. 

    5.    Redeeming the Grand Prize.  The winner must provide positive identification in such form as is specified by CMF to claim the Grand Prize.  The Grand Prize will be awarded only upon winner validation and verification by CMF.  The Ford Fusion will be physically available for redemption at the Country Music Hall of Fame® and Museum during normal business hours within five (5) days after the Drawing Date or arrangements can be made to pick up the Grand Prize at a local Ford dealer.  It is the responsibility of the winner to make all necessary arrangements to redeem the Grand Prize, including any costs of travel for the winner or transportation of the Grand Prize.  The Grand Prize must be redeemed by the winner no later than sixty (60) days following the Final Drawing Event.  No transfer or assignment of the Grand Prize is permitted without the consent of CMF.  In no event will more than the Grand Prize be awarded.  In the event that the Grand Prize is unavailable at the time it is scheduled to be awarded, CMF reserves the right, in its sole discretion, to substitute that prize with a prize or prizes of equal or greater value.  Acceptance of the Grand Prize constitutes permission for CMF to use the winner’s name, likeness, statements, voice, opinions, biographical information and state of residence for promotional purposes in any media without notice, further payment, consideration, credit, or right of approval or review (except where prohibited by law).  The winner will be required to sign an affidavit of eligibility and liability release within five (5) days after CMF’s request (except where prohibited by law).

    6.    Limitation of Liability.  By entering the Giveaway, each entrant agrees: (a) to comply with the Official Rules and the decisions of CMF and the judges, which shall be binding and final in all respects; (b) to comply with CMF’s privacy policy and terms and conditions; (c) to release CMF from all liability, loss or damage arising out of any participation in the Giveaway or in connection with the awarding, receipt, possession, use and/or misuse of any prize; (d) to be contacted by CMF by mail, telephone and/or email; and (e) that he/she acknowledges that CMF make no warranty, representation, or guarantee, expressed or implied, in fact or in law, relative to any prize, and disclaims all liability for the provision, quality or nature of any third-party products or services provided to the winner.  By entering the Giveaway, each entrant releases CMF, its officers, trustees, directors, employees, affiliates, subsidiaries, advertising, promotion, fulfillment, marketing agencies, public relation firms, consultants or contractors from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses to persons (including death) and property that may be sustained in connection with participation in the Giveaway and the receipt, ownership, possession, acceptance, enjoyment, use or misuse of any prize, or while preparing for, participating in, and/or traveling to any prize-related activity.  In no event will CMF, or its officers, trustees, directors, employees, affiliates, subsidiaries, advertising, promotion, fulfillment, marketing agencies, public relation firms, consultants or contractors be responsible or liable for any damages or losses of any kind, including without limitation indirect, incidental, consequential or punitive damages, arising out of any participation in the game or acceptance, possession, use or misuse of any prize awarded in connection with this Giveaway, including without limitation, personal injury, death and/or property damage, as well as any claims based on publicity rights, violations of protected speech rights or invasion of privacy.

    7.    Information and Content.  Any information provided to CMF by an entrant, including the entrant’s name, address, telephone number(s) and e-mail address(es), will be used to administer the Giveaway, communicate with entrants in relation to the Giveaway, for purposes of fulfilling any applicable prizes, providing necessary notice, or in connection with other appropriate purposes.  CMF will collect, use, and protect personal data in accordance with its privacy policy which is available for review at www.CountryMusicHallofFame.org.  All data is proprietary to CMF and will not be provided to unrelated third parties.

    8.    General Information.  CMF reserves the right to modify the Official Rules at any time for the purposes of clarifying and effectuating how the Giveaway is conducted.  Any changes to the Official Rules will be reasonably made with the intention of not materially affecting the terms and conditions of the Giveaway.  In the event of inadvertent computer or operator error, the unanticipated application, failure or effect of Giveaway mechanisms of play or individual components, software or hardware, or force majeure events affecting entry deadlines, the determination or notification of the winner, or the awarding of prizes, CMF reserves the right to modify, revise, add-to, or nullify the Official Rules, solely for purposes of conducting the Giveaway in a fair and reasonable manner and determining winners on an equal basis and without unfairly disqualifying otherwise eligible entrants from winning prizes.  All applicable federal, state and local laws and regulations apply.  Any and all disputes in connection with the Giveaway will be resolved exclusively in the appropriate courts in Nashville, Tennessee.  Should there be a conflict between the laws of the State of Tennessee and any other laws, the conflict will be resolved in favor of the laws of the State of Tennessee.  Each entrant waives any and all objections to jurisdiction and venue and hereby submits to the jurisdiction of those courts.  Any and all lawsuits or other disputes that arise relating to the Giveaway must be filed within one (1) year of the Final Drawing Event.  The failure of CMF to exercise or enforce any right or provision of the Official Rules shall not constitute a waiver of such right or provision.  If any part of the Official Rules is held by a court of competent jurisdiction to be invalid or unenforceable, that part will be enforced to the maximum extent permitted by law and the remainder of the Official Rules will remain fully in force.
